Terms and Conditions for JXJ Flooring services and products
1. Introduction
Welcome to JXJ Flooring. By accessing our services for the supply and/or fitting of flooring products, you (“the Customer”) agree to comply with and be bound by these Terms and Conditions (“Terms”). These Terms govern your contract with JXJ Flooring, a company registered in [Jurisdiction, e.g., England and Wales], for all flooring-related products and services provided.
2. Scope of Services
JXJ Flooring provides services including, but not limited to, the supply and/or fitting of flooring products. All services are conducted in accordance with industry standards, with reasonable skill and care. Our services do not include maintenance of flooring post-installation unless specifically agreed.
3. Liability
- Limitation of Liability: JXJ Flooring will not be liable for any loss or damage caused by events or circumstances outside our reasonable control. This includes indirect, consequential, or incidental damages, such as property damage, loss of income, loss of profit, or any other form of consequential loss.
- No Liability for Third-Party Installations: We accept no liability for any damages, issues, or losses arising from installations performed by third parties, including any work undertaken by individuals or entities other than JXJ Flooring employees or authorized subcontractors.
- Limited Liability for Product Performance: We source our products from reputable manufacturers and suppliers. However, JXJ Flooring makes no warranties or representations regarding the performance, durability, or longevity of products beyond those provided by the manufacturer. Any claims for product defects must be directed to the manufacturer under their warranty, if applicable.
- Exclusions: We are not liable for damages caused by improper maintenance, misuse, negligence, accidental damage, or wear and tear under typical usage. It is the Customer’s responsibility to follow recommended care guidelines for all flooring products supplied and installed.
4. Deposits and Payment Terms
- Deposit Requirement: A non-refundable deposit is required upfront for each project. This deposit covers the full cost of all materials required and confirms your order. No work will commence, and no materials will be ordered until the deposit has been received.
- Final Payment: The remaining balance, covering fitting and labor, is due upon completion of the installation unless alternative arrangements have been agreed upon in writing. We reserve the right to withhold completed work until final payment is made.
- Non-Refundable Deposit: In the event of cancellation by the Customer, we reserve the right to retain the deposit, either in part or in full, to cover any costs incurred. This includes materials that may already have been ordered or any preparatory work undertaken before cancellation.
- Late Payments: Failure to make payments on time may result in additional charges, including interest on overdue amounts, and may impact scheduling of further services. In the event of non-payment, we reserve the right to pursue legal action and to recover all legal and collection costs incurred.
5. Cancellations, Refunds, and Amendments
- Right to Cancel by JXJ Flooring: We reserve the right to cancel any project at our discretion. Reasons for cancellation may include, but are not limited to, unsuitable site conditions, unavailability of materials, or safety concerns. In the event of cancellation by us, we may provide a refund of the deposit after deducting any reasonable costs incurred.
- Customer Cancellations: Should the Customer choose to cancel the project after the deposit has been paid, JXJ Flooring reserves the right to withhold all or part of the deposit to cover costs, including but not limited to materials ordered, storage, and labor already rendered.
- Amendments to Orders: Any requested amendments to the scope of work or product specifications after the order has been confirmed may result in additional charges. Such changes must be agreed to in writing by JXJ Flooring and may affect project timelines and cost.
6. Product and Service Warranties
- Product Warranty: All products supplied by JXJ Flooring are covered by the manufacturer's warranty. We do not offer additional warranties for products and shall not be liable for any faults or defects beyond the manufacturer’s terms. It is the Customer’s responsibility to review and adhere to the manufacturer’s warranty terms.
- Installation Warranty: JXJ Flooring provides an installation warranty covering the workmanship of fitting services for [e.g., 12 months] from the completion date. This warranty covers defects in workmanship but does not cover issues arising from misuse, improper maintenance, or normal wear and tear.
- Limitations: JXJ Flooring’s responsibility under this warranty is strictly limited to rectifying faulty installation work. We will not be liable for indirect or incidental damages or for any costs beyond the cost of labor for the affected area.
7. Site Conditions and Customer Responsibilities
- Site Preparation: The Customer is responsible for ensuring that the site is adequately prepared for installation, including but not limited to clearing all furniture and obstacles. Any delays or additional labor required to prepare the site will be billed separately.
- Health and Safety: For health and safety reasons, pets, children, and unauthorized individuals must stay clear of the worksite while our staff or subcontractors are on-site. JXJ Flooring is not responsible for injuries or accidents arising from unauthorized access to the worksite.
- Access to Property: The Customer agrees to provide reasonable access to the property for the completion of services. Failure to provide access as agreed may result in delays or additional charges.
8. Limitation of Liability for Service Interruptions
- Force Majeure: JXJ Flooring shall not be held liable for any delay, interruption, or inability to complete a project due to circumstances beyond our control. This includes but is not limited to weather conditions, labor strikes, supply chain disruptions, acts of God, or government restrictions.
- Rescheduling: In the event of an unforeseen delay, JXJ Flooring will communicate with the Customer to reschedule services at the earliest possible convenience.
9. Insurance and Risk
- Insurance Coverage: JXJ Flooring carries liability insurance to cover accidents or damages caused by our employees or subcontractors on-site. However, this does not extend to damages caused by pre-existing conditions or issues outside our control.
- Risk Transfer: Once the flooring materials are delivered and/or installed, risk transfers to the Customer. JXJ Flooring is not liable for damages or loss after this transfer.
10. Data Protection
We are committed to protecting your personal data in accordance with applicable data protection laws. Any personal information collected will be used solely for the purpose of providing our services, including customer communication, order processing, and aftercare.
11. Amendments to Terms and Conditions
JXJ Flooring reserves the right to amend these Terms and Conditions at any time. The latest version will be available on our website and will govern any services performed after the date of the update.
12. Governing Law and Dispute Resolution
These Terms and Conditions, and any disputes arising from them, are governed by the laws of [Jurisdiction, e.g., England and Wales]. In the event of a dispute, the parties agree to first attempt mediation before pursuing further legal action.
